Under American law, U.S. government work-product cannot be copyrighted. But the government frequently ignores this law. For example, photographs on the U.S. Department of Defense Flickr page contain an assertion that they are copyrighted and “all rights reserved.”
This is generally a trivial matter, but in some cases it matters a fair amount. So cheers to Carl Malamud for trying to get the Smithsonian Institution to stop charging fees to people who want to use public images downloaded from its of historic American artifacts collection.
